What are the penalties for DWI?

  • Revocation of drivers’ license for six months to one year (or until 21 years of age)
  • Civil fees up to $125, suspension fees up to $100
  • Potential enrollment in New York Drinking Driver Program, including all costs and fees
  • Potential installation requirement of ignition interlock device, including all costs and fees

First-offense DWI penalties can include:

  • 90-day license suspension
  • Fines of $300-$500
  • Annual assessments for three years, which include $250 in fines
  • Jail time of up to 20 days
  • Potential enrollment in the New York Drinking Driver Program, including all costs and fees

Second-offense DWI penalties can include:

  • 6-month license suspension
  • Fines of $500-$750
  • Annual assessments for three years, which include $250 in fines
  • Jail time of up to 30 days
  • Potential enrollment in the New York Drinking Driver Program, including all costs and fees

Penalties for Aggravated DUI/DWI

The penalties that you might face become even more severe if there are aggravating factors. In DWI cases, aggravating factors can include excessive blood alcohol content levels (considered 0.18% or higher), causing injury, reckless driving, driving with a suspended license, or driving with a child present. The potential penalties for aggravated DWI can also increase due to prior offenses.

Aggravated DWI penalties can include:

  • 1 year to 18 months’ license revocation
  • Fines ranging from $1,000-$5,000
  • Annual assessments for 3 years, which include $250 in fines
  • Jail time of 1 to 4 years
  • Potential enrollment in the New York Drinking Driver Program, including all costs and fees
  • A Class E felony for second offenders
